YOU HAVE A RIGHT TO MEDIATION
Pursuant to Section 48-52 of Connecticut’s General Statutes you have the right to request the Ombudsman for Property Rights to mediate your dispute with the public agency that is seeking to acquire or has taken your property by eminent domain.
Asking the Ombudsman to help you negotiate a fair price or other important considerations from the public agency seeking to take your property is a good reason to request mediation.
Neither the Ombudsman nor the public agency can make you accept compensation you don’t think is fair. You always have the right to your day in court. But if you think it makes sense to try to settle your differences with the government before going to court then mediation through the Office of the Ombudsman for Property Rights may be the best option you have.
The Office of Ombudsman has prepared a set of guidelines and procedures including criteria that will be used by the Ombudsman to decide whether to accept or reject requests for mediation. The guidelines and procedures are designed to make it easy for a property owner to request mediation.
